The real problem with government and corporate corruption is that each of these entities are increasingly acting in the interests of no one but themselves. Once the government figured out that it was a "business," corruption became epidemic and the assumption became "to hell with morals." Our government now functions under capitalistic ethics. Government handbooks (their policy - the dusty book on the shelf) as well as their politics (what actually goes on) does everything but condone outright lying. Although government cover ups and lying has become a sport in Washington.

Almost everyday, I read more and more about judicial corruption. I personally want to believe that this is one area outside the influence of politics. This however does not work for me, or most of the public. I know this because . . . I was a judge for the EEOC which is probably one of the most corrupt judiciaries in the nation. Ordered by the Chairwoman Cari Dominguez to change my decision in a finding of discrimination in favor of two women attorneys and against the Securities and Exchange Commission, the Chairwoman, stated "[she] did not want a sister agency to suffer." When I absolutely refused to change the decision, I was grossly harassed and retaliated against for years - even to the point of a supervisor telling me that I would be dead - by their hands or my own. It's on the record. This is old news for politicians who have personally sought out and corrupted our judicial system. Yet, most American's truly want to believe they can still get a fair shake once they get their day in court, that is if they even get that far. The abuse of power under the color of authority is when a public figure, regardless of elected or appointed, attempts to interfere with the one last citadel citizens believed was without and above corruption, our judicial system. I have seen some of the very worst corruption in the EEOC's judiciary yet the public, albeit aware of corruption, is clueless as to the depth and breadth of the problem. Like the murder of Kennedy do we have to place the truth in a container and bury it in the ground for fifty years or can we face up to it now, and rid ourselves of the problem. I for one cannot tolerate a justice system that is no longer capable of responsibly dispensing justice. I am sick of influence peddling when it comes to judges deciding on a matter where cases become precedent. The players know what is going on while the rest of us missed the memo. Had I personally known what the EEOC judiciary was capable of inflicting on one of their own judge's, especially on a disable person with two terminal illnesses, I would have avoided the system at all costs. I was definitely way too naive to see my very own personal destruction coming at me like a freight train. Truth is really stranger than fiction. The bogey-man is real, not some made up story for prime time but alive and well in government institutions.

What to do - what to do? Perhaps one of you will have an answer. Hope springs eternal.

Legal ethics have been dumbed down, completely eliminating "right" from "wrong." Moral considerations are now optional. Public officials and those appointed individuals to positions of power have lost their consciences. No longer is a position of public trust a noble calling to serve others.

The call of the question is what to do when the government is in dire need of a moral makeover, and who will impose it? The problem is far beyond the greatest spin doctors. A good dose of honesty, integrity and sensitivity to human decency would be a great start. Public officials must be held to a higher standard of conduct. Any external steps to eliminate corruption or combat the effects thereof are poor substitutes for personal moral character. No external inducements can take the place of higher spiritual aspirations, with strong and unshakable convictions that corruption is dishonorable, and that ultimately dishonor is truly worse than death itself.

Does anyone here know of someone worthy of the cause? Someone, and I mean someone soon, needs to step up to the plate, and be the change agent we so desperately need.

The Demise of Joe Lunch Bucket and the Arrival of the "Stepford' Employee

Everyday in reading the news paper,listening to the news or hearing a politician speak I am ill, and enraged. Joe Lunch Bucket was the man who went to work without fail everyday. He brought leftovers from last night's dinner, he worked in manufacturing with widgets and gadgets, and at the end of the day went home to his family. Joe had health care benefits, he paid his taxes, he made enough to pay his bills, buy a home for his beloved family, and was the backbone of our society. There are no more Joe Lunch Buckets. His jobs went oversees because corporate America was and remains indifferent and greedy. Without a single thought about their part in destroying America they thought about money and plenty of it when profit margins soared by shifting the work of Joe Lunch Bucket to China or third world countries. Boardrooms collectively rubbed their hands together and said "Goody Goody for us." Joe Lunch Bucket never had a prayer. At no time did these corporate players give one thought to the demise of Joe Lunch Bucket and the ripple effect to his family and to society as a whole.

Now enters the "Stepford employee. I am sure you saw the movie "Stepford wives who were given a lobatomy so they could not speak up or out about an unfair situation in their marriages. Now, life is stranger than fiction: here is the deal. The federal government is the single biggest employer in the United States. JOBS is the single, hottest four letter word in America (actually the lack thereof). When a federal worker has a conflict with his employer that smells like, walks like, and quakes like a duck - it is a duck or more commonly known as discrimination, whistle blowing or retaliation, he has no where to take a legitimate dispute to the only place he could go - the EEOC, because it is and has been proven to be grossly corrupt. (See my other blogs.) Now comes the Stepford employee, he cannot complain because he will almost assuredly lose his job. No one can afford to lose their jobs especially with entities such as Monster.com who boldly say, "DO NOT BOTHER TO APPLY IF YOU ARE UNEMPLOYED." Now he has figured out that his mode of survival is as follows: "yes sir, no sir, how high sir, anything else sir!" Regardless of the corrupt, illegal instructions he has been given there is no avenue to stand up and contest. He is a quick study - he looks at his friends or friends of his friends who spoke up, their lives were obliterated as well as their families in the ripple effect.

Congratulations to the politicians, government agencies and corporate America - the citizens have been righteously screwed. Joe Lunch Bucket is desperately needed in our economy and as a fine upstanding citizen we need his vote. Stepford employees will eventually say "no more!" - and riot in the streets. Unfortunately, the leaders of our country will call forth the militia and then democracy is dead! Query - think about it, it is happening as we speak. Help me call attention to this and do something about it!

Judging Me

To My Dear Readers,

I have a new book soon to be published called, "Judging Me." This book has nothing to do with the fact that I was a federal civil rights judge as it has to do with a child raised in poverty, who was violently sexually abused and became a federal civil rights judge. It is more about overcoming adversity and is addressed to those people who are disillusioned, dispossessed, and disenfranchised. Everyone has a story to tell if others would only listen. In the beginning, the story is dark and depraved but ultimately like the critics have said, "It is truly the most inspirational." As I frequently, state, "If I can take the debris of my life and fashion it in such a way that I help one other person, than what happened to me was worthwhile." I hope that you too will find that it is a breath of hope for those who have no hope. When I convey the brutalities and cruelties it would have been understandable that my life would have gone according to statistics and case studies. And, yet, it did not. "Why does a flower that grows through the crack of a sidewalk without purchase for a solid root base, through angry rains and careless people, turn out to be a miracle in its own right? It is about choices, life enhancing or life diminishing. Not one of us abdicates our right to choose, unless you are one of those people who decide life is not for the joy of becoming who and what you want to be but rather what those little houses of horror hone you to become - another monster. I beat the odds and so shall you, my reader. My name is Mary Elizabeth and this is my journey."

Government Corruption

Most people do not want to look at the world. Today, the world has been deceived about fundamental realities. All these deceptions become woven into the fabric of our lives. Therefore, in telling the truth it becomes a revolutionary act on two levels: personal; people want to be deceived because they do not want to know the truth about our world,i.e., one out of five children are below the poverty level in the United States - the highest rate among the industrialized nations, the truth upsets people so as a general rule people quiescence; institutional, including the government, requires deception of society so the power structure remains in place and benefits from having people a sleep at the wheel. Corruption is about money and power, without the benefit of a legitimate legal system there is nothing to stop the abusive practices. Since we no longer have the benefit of the law there are and will continue to be abuses within the system. The United States of America has run amok! There is no one or no entity willing to stop the horrific abuses because those at the top receive all of the gain. Which one of them will turn away from all the money they continue to receive because of the corrupt system? The government initiated and perpetuates the corruption.

Who is willing to step up to the plate and oust these outlaws? I for one cannot do it all. The more people who come together and demand authentic accountability of our politicians, bankers, etc., the more we as a country will survive rather than implode which is where we are headed. This is a mandate of and for the people. We cannot afford to be deceived for another second. Harsh as the truth is we have to face the fundamental realities that we have been lulled into believing are true when in fact they are bold-faced lies. Demand the government do its job!

Corruption in the EEOC



Dear Friends,

The gestation period for this particular blog has taken far too long, it is inspired by the most banal, and for the uninitiated, most questionable of all motives - personal outrage. Organizations become dinosaurs overnight because they fail to listen to the groundswell of an underground movement that has become organized and loud in the varying complaints of a system that perpetuates corruption. The internal corruption within the EEOC has been well documented and demonstrated.

There are drastic consequences of placing far too much power and authority in the hands of the EEOC when they cannot administer justice responsibly. The American justice system has witnessed the horrifying retreat of facts turned into fantasy. The EEOC has run amok in both Congress and the courts wielding unchecked power and influence. The system is propelled by powerful propaganda, virtually impregnated arrogance, and greed: reason gone mad, zero accountability; and money carries the day. The EEOC is a farce, it perpetuates horrific injustices.

Well meaning people tell us that "time heals all." It is a lie, especially when the wound is constantly ripped open by the intentional acts of others in a conscious attempt to hide the truth. Congress needs to step in for there to be any effective changes.

Invictus

My Dearest Friends,
There is a British Poem I would like to share with everyone that struggles day in and day out for sanity. Remember why we struggle as the poem says "we are the captain of our soul."

Invictus
Out of the night that covers me,
Black as the Pit from pole to pole,
I thank whatever gods may be
For my unconquerable soul.

In the fell clutch of circumstance
I have not winced nor cried aloud.
Under the bludgeonings of chance
My head is bloody, but unbowed.

Beyond this place of wrath and tears
Looms but the Horror of the shade,
And yet the menace of the years
Finds, and shall find, me unafraid.

It matters not how strait the gate,
How charged with punishments the scroll,
I am the master of my fate:
I am the captain of my soul.


At times, even I want to walk away from a fight that will kill me in the end. But, I know I am hard-wired for justice and fair play. If I turn my back on corruption at all levels then who will fight my fight. I have been able to secure justice for hundreds, but I fear no justice for myself. Invictus reminds me of who I am.

The EEOC Retaliates Once Again

My Dearest Friends,

I found out from the State Bar that they did not place on Google what would appear at first blush to be from the State Bar. Instead this was posted by the EEOC in retaliation for my reporting four different Administrative Judges for failure to have active licenses and blatantly practicing law without a license. What is contained therein is nothing but their lies in an effort to make me look like a person without ethics. Coming from my background, poor and violently abused, I swore to make my life different from my family's. For all my hard work they destroyed my fifty some years of hard work and dedication.

Retaliation for Speaking the Truth

To My Dearest Friends,

Two days after filing a complaint about unlicensed judges to the California State Bar they posted on Google that I am not allowed to practice law. This was in retaliation for reporting two of my previous supervisors for not having active licenses for decades. Whether this was the State Bar's idea or the EEOC under John Sherlock, I will probably never know. However, note this fact: this posting is something that the State Bar NEVER DOES. It was meant to humiliate me and further their retaliatory actions against me. The EEOC is corrupt and in a vector like fashion reaches out to other organizations promising favors et al. in an effort to destroy another's livelihood. It was not enough for the EEOC to destroy me while employed by them. Years later even after I left their employment the EEOC continued to retaliate and does so to date. What are they afraid of after four years? Plenty I assure you. Truth and Justice cannot prevail when the EEOC is so powerful. It is time for Sherlock to be punished for forcing others to perjure themselves while he too violates the law, counts to numerous to mention. His acts and those of others are criminal in nature. Make no mistake their corruption exceeds all bounds of decency and civilized behavior. The question to be asked and answered is why the EEOC does not want me to have my day in court? Answer: Since 1999, my doctor and I asked for accommodations, in April of 2000, I was declared legally blind. The request for accommodations are to numerous to count, but did not happen until we were in the middle of my trial. I have all of the e-mails from Washington D.C., Office of General Counsel which state that under no circumstances should I be accommodated at any point, especially during the trial. I received outstanding performance evaluations through 2003 and no cases were overturned. I filed my case in 2003. My trial was in 2005 and lasted almost two years. The EEOC needed this time to paint me as a rogue employee, unethical, and a trouble maker. They destroyed evidence and lied through their teeth. If speaking the truth is so hard on the EEOC then my DIRECTOR should have never had office meetings where he was only concerned about the number of case closures since his Christmas bonus was tied to this number. As I stated before, I raised the issue that his question was inappropriate since it should have been "how much justice did we serve." Trust me when I relay that I did not get paid my full salary, and was one more Christmas I wrapped presents for my children that I gave them from previous years. How I wept for what I thought could make a difference in the world as so many employees were entitled to the same justice as others and as so stated in the mission statement. When will Congress have hearings about the illegal acts they perpetrate especially on their own employees. When will Congress get off their "proverbial ass" and do something? How many body bags will it take? I believe Congress knows full-well what has been happening for decades but turn a blind eye. Clarence Thomas was the Chairman for the EEOC when he defamed Anita Hill. It just goes on and on. Decades of corruption that repeat themselves over and over. I will be retaliated again in ways you won't believe. Stay tuned, I won't keep silent.

In conclusion the EEOC's appellate brief makes two arguments, the first is "That I am not dead yet," and of course the other is that I failed to exhaust my administrative remedies. How can a person exhaust their administrative remedies when Sherlock places the appeal in the wrong venue. Employees of the EEOC, especially those acting as judges, are supposed to go straight to the Commission. I knew this and filed in federal district court within sixty days. Sherlock, in even more illegal actions submitted evidence to OFO after the period for all submissions had passed. Even after Sherlock admitted evidence long after the regulations allow, i.e., my federal complaint, he still held on to it for six more months. All in hopes that I would die. Now he wants to employ more stress which he knows a person with terminal illnesses cannot tolerate. Although, I could use a few choice words to describe him, I am too much of a lady to do so.

Administrative Judges - No Such Title

Administrative Judges are referred to as Attorney Examiners. As such they must be licensed by their various State Bars. Unfortunately, many have let their licenses become inactive and as such are practicing law without a license. In essence this means that every decision made by an unlicensed judge is reversible because under the Business and Professions Code as well as the State Bar Rules it is illegal to practice law without a license. John Sherlock III, of internal litigation with the EEOC, argues before Congress and others that Administrative Judges are not required to be licensed. Yet, I hold a letter Sherlock wrote to the California State Bar admitting such a fact. OPM (Office of Personnel Management) also has regulations which require this as well.  Most agencies check each year that their attorneys are indeed licensed.  Why does Congress turn a blind eye when it comes to the EEOC? Because all of the cases heard by the unlicensed judges would have to be overturned and reheard. This would open a floodgate of litigation. Report unlicensed EEOC judges to their respective State Bars. They should be sanctioned, disciplined and terminated from their positions as Attorney examiners as they are currently perpetrating a fraud upon the taxpayer. What do you think about this gem!

The Protector Became the Abuser

Justice is truly one of the most difficult pursuits today because our court systems have  been corrupted. Those individuals who are either dispossessed, disillusioned or disenfranchised have no hope for vindication of their rights because the system was designed for the wealthy.  In an attempt to secure such an illusive concept many people have observed that a trial is the last blood sport in civilization. For many attorneys they are not interested in the truth of your story but rather the subjective truth. A trial is no different than any drama on television. Attorneys generally relay that your story will be told as you have described the injustices. However, what happens is that the truth, your truth, will never be told, especially by your attorney.  The goal is to win at any cost regardless of the damage to the individual. The better your facts are, and the rightness of the law in your favor  the pursuit for justice is oftentimes essentially worthless. At the end of the day what counts is who is standing in the pool of blood and who is down for the count. I have often wondered about how people who have perjured themselves or been involved in destroying good evidence and creating their own can look at themselves in the mirror or sleep at night knowing they have torn another person's heart out.  The goal of winning is no longer good enough, they must destroy the opposition so it can never rise again.  I know of what I speak. I served as a federal administrative civil rights judge. A goal I dreamed about since the age of seven.  A dream that came true on my 49th birthday.  Unfortunately, be careful what you wish for. One day I was approached by the management and told to change a sixty three page decision where I found egregious illegal conduct directed towards two Asian women attorneys. Gross violations of the law. My supervising judge read the decision and like the rest of my decisions found the work to be outstanding. The next day I went into the hospital where it was discovered that I had ovarian cancer. One day post surgery my boss telephoned me and demanded that I return to the office immediately. Under the worst personal circumstances, I went into my office only to find that the Director demanded that I change my decision to no discrimination or violations of the Equal Pay Act.  I was shocked. This was a direct order. I asked "Why." The answer was as follows: "The Chairwoman in Washington DC does not want a sister agency to be punished so harshly, regardless of what the women suffered.  I outright refused. I replied, "I do not change decisions just because you do not want the wrongdoer punished. I do not care who wants it changed or for what reason. My decision was on point. I immediately called a taxi and returned to the hospital.  My boss changed the decision and retaliated against me for any and all reasons.  I was the only judge who challenged their illegal and unethical policies and their concept of justice. Justice for these powerful individuals consisted of moving cases off their desk, it was always about closing cases, numbers. The better the office numbers the more my Director would receive as a Christmas bonus.  It was never about serving those individuals who had suffered tremendously because their employers either fired them, were denied promotions, held to different standards than their co-workers all because of their color, national origin, sex, disabilities, or race. Based on underlying prejudices against people who by the very nature of their birthing could not change.  Every year during staff meetings I raised my hand to state the obvious, "Sir you must not be familiar with our mission statement and the ensuing enabling legislation. The question should be "how much justice did we accomplish.'"  The agency I worked for, the EEOC, "the model employer" was given the mission of eradicating all vestiges of discrimination and retaliation. Yet, knowing that I was disabled by having multiple sclerosis and lupus the EEOC did whatever they could to destroy me.  My supervisor said the following words to me, "Mary Elizabeth don't you get it yet, you will win your case but you will never see a dime, you will be dead - either by our hands or your own. I was devastated. I filed suit for failing to accommodate a request for a software program to help me see because I am legally blind.  After four years of my requests and my physicians I filed suit against my own employer.  Powerful people perjured themselves in bearing false testimony against me, and devised methods of destroying evidence and crafting their own to paint a picture of a rogue employee. From headquarters in Washington DC to Los Angeles they choreographed and orchestrated a full scale war against me for speaking out.  The Protector became the Abuser.  I am now in the 9th Circuit, pray for a miracle. The Agency's machinations were so convincing as they painted me to appear as a rogue employee. Everything was a lie.  If the EEOC can do this to a judge, imagine what they can do to those who are unaware of the law.  To date their behavior has not changed.  No one single agency or board really reviews what the EEOC does.  The corruption is endemic, there is no hope for change unless I, as well as others, can have their day in court.  I have seen evil in all its forms.  As a child I was violently sexually abused by my parents for ten years.  Who could betray a child more than their parents in this manner. Who could betray a disable employee who suffers from two terminal illnesses  more than the EEOC?

The pursuit of justice remains illusive. The EEOC, represented by the U.S. Attorneys' Office, have hundreds of lawyers. Even if I do not get the chance to change the law because the 9th Circuit Court found in favor of the EEOC, I will still make sure that the truth and my belief in justice will be accomplished as I am attempting to complete another life long dream, my book titled, "Judging Me."  A tragic autobiography but nonetheless incredibly inspiring (as I have been told).  Justice will prevail with time, enough money, and help from those who believe in me and what I am doing.  I have dedicated my life to helping others.  A majority of the proceeds from the book will go to those who have also been abused. I believe if they have a dream which would enable them to break away from their dispair and the obstacle is money than  perhaps in the proceeds from the sale they will get an opportunity to have hope realized into a reality.  As I have said repeatedly, "If I can take the debris of my life and fashion it in such a way that it helps just one other person, then what happened to me was worthwhile.  Ultimately, you will be the judge of that!

I apoligize if I wrote too much, but it is my first time.  Thank you in advance for any feedback. There is no ego here.  Sometimes my own depression seems to overwhelm me because I am very much alone. To those gentle people who took the time to read this I thank you more than words can express.
